100-NIGHT TRIAL & LIMITED WARRANTIES

First and foremost, thank you for purchasing your new Nighslee product(s). We hold ourselves to unbelievably high standards and truly put forth every effort to give you the best sleep.
We get it, time is valuable. Who has time to flip through pages of warranty? So, here are the basics. The fine print is down below.

  • Try your product for 100 days*, if you are not satisfied, we’ll take care of it and give you a full refund.
  • Limited to one refund, per household, per year.
  • Only if purchased from us @ Nighslee.com or Amazon.com*.
  • Your mattress will be under our warranty for 10 years* covered from the date of purchase! A whole decade of comfort.
  • Covers manufacturing defects, sag in the foam*, or flaws which caused tears in the foam or fabrics.
  • Does not cover damage from sailing, paragliding, flying down a snow slope, or any other extreme uses not intended* for a mattress. (Don’t try this, please.)

THE 100-NIGHT TRIAL POLICY AND OUR LIMITED WARRANTIES ONLY APPLY TO ORIGINAL PURCHASERS OF GENUINE NIGHSLEE PRODUCTS PURCHASED DIRECTLY FROM AUTHORIZED NIGHSLEE DISTRIBUTION CHANNELS AND, IN THE CASE OF THE 100-NIGHT TRIAL, MAY APPLY ONLY TO THOSE PURCHASERS WHO PURCHASED DIRECTLY FROM NIGHSLEE. PURCHASES MADE FROM AMAZON.COM MAY BE SUBJECT TO DIFFERENT OR ADDITIONAL TERMS. PLEASE KEEP YOUR ORIGINAL PURCHASE RECEIPT IN ORDER TO TAKE ADVANTAGE OF OUR WARRANTY. 100-NIGHT TRIAL POLICY

You can return your Nighslee product(s) for a full refund by contacting us via contact@nighslee.com. If you’re not completely satisfied —for any reason— during the first 100 nights. Please kindly note that we are unable to refund the shipping fees which were originally shipped to an address in Alaska or Hawaii. In addition, your returned mattress will likely be donated to charity for those in need.

Nighslee will cover related charges if pickup is necessary. This does not include international purchases. Your mattress must be located in the United States if you wish to take advantage of the 100-Night Trial Policy.

Please note that, in all cases, the original receipt showing proof of purchase is required to take advantage of the 100-Night Trial Policy.

This policy is limited to one return per household per year, and it must be exercised directly with Nighslee no later than the 100th day following delivery to your door of the product you wish to refund.

As a reminder, our 100-Night Trial Policy only applies to the original purchaser of genuine Nighslee Products purchased directly from our website at Nighslee.com. The 100-Night Trial Policy may not apply, or may apply differently, to purchases of Nighslee Products via other authorized Nighslee distribution channels (Amazon.com) or from other (unauthorized) sources. The 100-Night Trial Policy only applies during the period in which the Product is owned and controlled by the original purchaser of said Product.

10-YEAR LIMITED MATTRESS WARRANTY

Who and what is covered in this Warranty?

We believe in our quality and offer a 10-Year Limited Warranty to prove it.

Your new Nighslee mattress (hereinafter “mattress” or “Product”) is covered by a 10-year limited warranty (the “Warranty”), which gives you specific legal rights as a customer. You may have other rights, but those could vary on your location. This Warranty is non-transferable and covers only the original purchaser and current owner of the Nighslee mattress (the “Product”) and purchased it directly from an authorized Nighslee distribution channel – Nighslee.com or Amazon.com. The Limited Warranty, therefore, only applies during the period in which the mattress is owned and controlled by the original purchaser of that mattress.

PLEASE RETAIN YOUR PURCHASE RECEIPT SO THAT YOU CAN PRESENT IT TO US IF NECESSARY.

In addition, because we cannot handle international shipping and logistics expenses, your mattress must be in the United States at the time you wish to take advantage of the Warranty and is limited to material defects resulting from defective materials or workmanship in the Product you have purchased.

*Specifically, this Warranty covers the following defects, provided that they arise or appear in circumstances in which you have handled, maintained, and used the Product only for its intended purpose and have not subjected it to extreme conditions unsuitable for a mattress.

  • A visible indentation or sag greater than three-quarters (3/4) of an inch in the foam.
  • This refers to an indentation that is visible when no weight is applied to the Product. Please note that “normal wear” requires your mattress to be continuously supported by a proper foundation adequate to support the distributed weight of your body and the mattress.   • Any flaw in the foam material which causes it to break.
  • Any manufacturing defect in the mattress cover such as fabric tears or unraveled stitching.

What will Nighslee do?

In the rare and unfortunate event our product does not hold to our standard, we will repair or replace the defective Product or the defective component(s) of the Product (e.g., the mattress cover, if applicable). If there is a flaw in a component of the mattress (e.g. the mattress cover), we reserve sole and complete discretion to repair or replace the component rather than replace the entire mattress. If we elect to replace the Product or component, we will replace it with the model, version, color, or style available at the time of replacement, which may be different in certain respects than the original. If you wish to replace the defective Product with a more expensive Product, you may be required to pay the difference in price in order to upgrade to a more expensive Product.

REPAIRS OR REPLACEMENTS WILL NOT EXTEND THE ORIGINAL PERIOD OF LIMITED WARRANTY, NOR WILL IT BEGIN A NEW LIMITED WARRANTY PERIOD.

How long does the Warranty coverage last?

Our warranty lasts for ten (10) years from the date of purchase. We don't pro-rate the terms (i.e., we don't reduce the total amount as time goes on).

What is not covered by this Warranty?

*Specifically, this Warranty does not cover the following:

  • Normal wear and usage.
  • Changes caused by or resulting from conditions or uses that are outside the ordinary, intended maintenance and uses of a mattress — specifically reclining and sleeping.

Some grade of individualization of your Nighslee mattress should be anticipated. Each mattress is not same. There may some minor imperfections which do not prevent enjoyment or normal use and not to be considered defects. This may include, but not limited to, surfaces not being perfectly even, corners not perfect shaped or symmetrical.

More specifically, this Warranty excludes: (a) minor imperfections and slight cosmetic flaws; (b) normal wear and tear; (c) tears, stains, soiling, burns, and discoloration that occur naturally over time; (d) dampness or mold; (e) individual or personalized preferences; (f) sags or indentations not greater than 3/4” below the quilt level – in other words, some settling of the fiber in the quilt is and should be expected and is not considered a defect or flaw; (g) individual or personalized allergies and sensitivities; and (h) naturally occurring aromas.

In addition, conditions resulting from wrongful handling, misuse, or neglect are not covered by this Warranty.

The following conditions, if discovered, will void your warranty: (a) any unsanitary or contaminated condition; (b) burns; (c) use of the Product on improper support (e.g. bed frame); (d) physically mistreating the Product; (e) using improper cleaning solutions and/or methods on the products (f) improper storage of the Product (including storage in damp locations, areas infected with insects or rodents, or any other unprotected storage areas); and (g) purchases made from unauthorized retailers.

MEDICAL OR HEALTH CLAIMS

Nighslee will not make any medical or health claims regarding its mattresses. Allergies, discomfort, or other conditions, are not covered under this Warranty. If you have any questions or concerns regarding medical or health conditions should be addressed by a licensed physician. If it is an emergency, contact emergency services.

MAKING A CLAIM

To make a claim under this Warranty, please send:

  1. A brief description of the issue or condition that you believe to be a defect; attach any photos if possible.
  2. Proof of purchase (such as your order number or an original dated sales receipt) to Nighslee at contact@nighslee.com.

Any failure to comply with these instructions may void this Warranty. We reserve the right, at our sole discretion, to require photographs, further information or descriptions, or to physically inspect the mattress prior to accepting a particular claim under this Warranty.

PLEASE RETAIN THIS LIMITED WARRANTY AND ORIGINAL PROOF OF PURCHASE FOR AT LEAST 10 YEARS FROM YOUR DATE OF PURCHASE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AUTHORIZED RESELLERS, DISTRIBUTORS, AND/OR SUPPLIERS MAKE NO REPRESENTATIONS, WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, BEYOND THOSE SET FORTH HEREIN AND CLAIMS IN OUR MARKETING MATERIALS. EACH OF THOSE PARTIES DISCLAIMS ANY AND ALL WARRANTIES OR CONDITIONS, EXPRESS, STATUTORY AND IMPLIED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS, SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

NIGHSLEE SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF THIS PRODUCT OR ARISING OUT OF ANY BREACH OF THIS WARRANTY; THE EXCLUSIVE REMEDY FOR BREACH OF THIS WARRANTY SHALL BE REPLACEMENT OR CREDIT TOWARDS

REPLACEMENT AS SET FORTH HEREIN. THERE ARE NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND SUITABILITY FOR A PARTICULAR PURPOSE, OTHER THAN THE WARRANTY DESCRIBED ON THE FACE OF THIS LIMITED WARRANTY.
